Terms and Conditions
These terms and conditions are issued by Racing and Wagering Western Australia (ABN 21 347 055 603) of 14 Hasler Road, Osbourne Park (Promoter) in relation to TABtouch Western Trilogy Quokka (Promotion).
Entering into the Promotion is deemed acceptance of these terms and conditions as set out in this document.
Promotional Period
The Promotion commences at 8.00AM (AWST) on Wednesday 1 April 2026.
Entries close at 11:59PM (AWST) on Wednesday 15 April 2026.
The Promotion ends at 11:59PM (AWST) on Wednesday 15 April 2026.
Eligibility
Entry into the Promotion is open to TABtouch account holders Australian residents aged 18 years or older only who are not;
a) Employees and immediate families of the Promoter and its agencies and suppliers and contractors to the Promotion, including the Venue, are not eligible to enter. For the purpose of this Promotion, immediate families is defined as mother, father, sister, brother, spouse (including de facto), offspring, living in the same premises; b) agencies of the Promoter and vendors or other companies associated with the Promotion; c) residents located in Victoria, Queensland, New South Wales, South Australia, Australian Capital Territory, Tasmania and Northern Territory.
Entry Criteria
To enter the Promotion, Eligible Entrants must provide age, telephone number and Australian residence.
Entry is restricted to one Eligible Entry per Tabtouch account holder during the promotional period.
Entries received after the close of the Promotional Period will not be accepted.
It is the responsibility of each Eligible Entrant to ensure that their Entry is properly submitted and received by the Promoter, including but not limited to entering the correct details on their Entry. The Promoter is not responsible for any lost, late or misdirected Entries due to an error of an Eligible Entrant.
Entries will be deemed void if illegitimate, forged, manipulated or tampered with in anyway.
All valid Entries submitted by Eligible Entrants prior to the Entry closure date will be included in the draw.
The draw will be conducted by using a random draw via computer, operated by a member of the CRM Team.
The draw will take place at 12.00pm AWST, Thursday 16th April
The Entries drawn on the Prize Draw Date will be deemed the winner(s) of the Promotion (Winner(s)).
The Promoter will take reasonable efforts to contact the Winner(s) in accordance with the contact details provided in their Entry.
If the Winner(s) cannot be contacted within three (3) months of the Prize Draw Date or is unable to accept the Prize, an additional draw will take place in accordance with the same procedures as the original draw (Unclaimed Prize Draw).
If necessary, an Unclaimed Prize Draw will be held Friday 17 July, 2026.
Prizes
The total value of this Trade Promotion is prize pool is up to $80,000 – and will be shared equally amongst 4 different prize winners.
4 x Eligible Entrants will be selected by random draw to win $10,000 cash each.
If TABtouch The Quokka slot holder contender horse Luana Miss places 1st, 2nd or 3rd in The Quokka horse race on the scheduled date of 18 April 2026, Ascot Racecourse, 71 Grandstand Rd, Ascot WA 6104 the 4 x Eligible Winners will receive an additional $10,000 each for a total additional bonus prize pool of $40,000.
If Luana Miss is scratched from The Quokka, the competition to win one of four (4) AUD $10,000 cash prizes will continue as scheduled.
If Luana Miss is scratched from The Quokka and not replaced by another runner, the additional prize pool of $40,000 based on her potential place in the race of will be null and voided.
The Prize (or any part thereof) is not transferable or exchangeable for other goods or services.
Once contact has been made with the Winner(s), Prizes will be delivered, paid or transferred (as applicable) to the Winner(s) within 28 days after the Prize Draw Date.
In the event that the Prize (or any part of the Prize) becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute the Prize (or the relevant part of the Prize) with a prize of equal or greater value.
All taxes (excluding GST), which may be payable as a consequence of receiving the Prize, are the sole responsibility of the Winner(s). The Promoter accepts no responsibility for any tax implications that may arise from accepting the Prize. Independent financial advice should be sought.
Collection and Use of Personal Information
Personal information including the Eligible Entrant’s name, address, telephone number and email may be collected and used for the purpose of conducting the Promotion.
By entering this Promotion, Eligible Entrants consent to the use of their personal information in accordance with these terms and conditions.
Eligible Entrants may access, change or update their personal information by emailing the Promoter on ContactUs@tabtouch.com.au or by telephone at 1300 36 36 88 during office hours. The privacy policy contains information about how individuals may access or correct personal information or make a privacy-related complaint.
Governing Law and Jurisdiction
These terms and conditions, the Promotion and any claim or dispute between the Promoter and an Eligible Entrant are governed by the laws of Western Australia
Eligible Entrants submit to the non-exclusive jurisdiction of the courts and tribunals of Western Australia in connection with any dispute concerning these terms and conditions and the Promotion.
Dispute resolution
In the event of a dispute concerning the conduct of the Promotion or a Prize, Eligible Entrants must contact the Promoter to attempt to resolve the dispute in good faith.
If the matter cannot be resolved, either party may refer the matter to mediation and the costs of mediation will be shared equally between the parties.
General conditions
Should an Eligible Entrant’s contact details change during the Promotion Period, it is the Eligible Entrant’s responsibility to notify the Promoter. The Promoter takes no responsibility where it is unable to contact a Winner(s) who has not provided correct or complete contact details.
The Promoter reserves the right to disqualify any individual who submits an Entry that is not in accordance with these terms and conditions, or who is involved in any way in interfering or tampering with the conduct of this Promotion, has breached any of these terms and conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion.
In the event that a Winner(s) breaches these terms and conditions, the Winner(s) will forfeit the Prize in whole and no substitute will be offered. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Winner(s) has rights under the Australian Consumer Law and other similar legislation which cannot be excluded, restricted or modified by the Promoter. These terms and conditions do not exclude, restrict or limit those statutory rights in any way. However, to the extent that it is permitted to do so, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation:
- a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
- b) any theft, unauthorised accessor third-party interference.
- c) any Entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter.
- d) any variation in market value to that stated in these terms and conditions.
- e) any tax implications; or
- f) the Prize or use of the Prize.
If for any reason beyond the reasonable control of the Promoter the Promotion is not capable of running as planned, the Promoter reserves the right in its sole discretion to take any action that may be available to it, and to cancel, terminate, modify or suspend the Promotion, unless to do so would be prohibited by law.
