1 General
1.1 Racing and Wagering Western Australia’s (RWWA) Bet Loop feature (Bet Loop) is
provided to you on these terms and conditions (Bet Loop Terms and Conditions)
along with RWWA’s TABtouch Terms and Conditions and the Rules of Wagering 2005
(WA) found here (collectively, Rules).
1.2 Please read the following Bet Loop Terms and Conditions carefully. By accessing Bet
Loop and/or using any of its features, you agree to be bound by these Bet Loop Terms
and Conditions and the Rules.
1.3 Capitalised terms in these Bet Loop Terms and Conditions have the meaning given to
them in the Rules, unless the context indicates otherwise.
1.4 If you have an existing verified TABtouch account (which is used in accordance with
the Rules) RWWA may make features (Bet Loop Features) available that allow you
to generate a profile (Bet Loop Profile), use your Bet Loop Profile to share information
about your bets, follow other Bet Loop Profiles and copy other bets.
2 Creation of Profiles and Content
2.1 You must create a unique username to generate a Bet Loop Profile.
2.2 You have the option to generate a bio.
2.3 Upon creation, your Bet Loop Profile including your username and bio will be
immediately public and able to be viewed by others including to other users of the Bet
Loop Features. Due to this public status, you should not include any information which
could be used to identify you. For example, do not include your date of birth, full name,
address, phone number, email address or any financial or banking details.
2.4 Creation of your Betloop Profile, username and bio is at your own risk. To the extent
permitted by law, RWWA is excluded from all liability whatsoever in connection with
your username and bio and you indemnify RWWA from any liability caused by your
username and bio.
2.5 Use of the Bet Loop Features should be a positive and enjoyable experience for all
users. You must ensure that any content, messages or other information that you make
available in connection with your Bet Loop Profile (Bet Loop Content) complies with
all laws, all requirements set out in these Bet Loop Terms and Conditions and any
other acceptable use policies or requirements that RWWA may publish in relation to
the Bet Loop Features from time to time.
2.6 It is your responsibility to make sure that your username, your bio, your Bet Loop
Content and any other information that you post when using the Bet Loop Features
does not involve, and could not be reasonably perceived to:
(a) infringe any laws
(b) infringe RWWA or a third party’s intellectual property or any other rights of any
kind;
(c) violate rights of another person, including another person’s privacy or
confidential information;
(d) be offensive, defamatory, intimidatory, discriminatory, bullying or incite violence
or hatred, or include profanities (including incorrectly spelt profanities);
(e) imitate, mimic or satirize any other person or group;
(f) include content that does not relate to the purpose or subject matter of the Bet
Loop Features;
(g) encourage or constitute antisocial conduct, including illegal or violent conduct;
(h) be false, misleading or deceptive information;
(i) encourage any irresponsible behavior or activity, including drinking or drugtaking;
(j) encourage irresponsible wagering;
(k) be spam or duplicate messaging; or
(l) include any other prohibited information identified in any other acceptable use
policies or requirements that RWWA publishes in relation to the Bet Loop
Features
3 Suspension, cancellation, deletion of Bet Loop Profiles and Bet Loop Features
3.1 RWWA may at any time and for any reason in its absolute discretion, with or without
notice and without any liability to you, delete, block, cancel, change or restrict a Bet
Loop Profile, Bet Loop Content or the Bet Loop Features, including:
(a) removing, deleting or deactivating any Bet Loop Profile:
(b) render your Bet Loop Profile ineligible for promotions (in part or full); or
(c) ban you from creating a Bet Loop Profile or using the Bet Loop Features.
3.2 It is intended by RWWA that if you have:
(a) registered with BetStop – the National Self-Exclusion Register (available here)
(Self-Exclusion); or
(b) opted to Take a Break in accordance with RWWA’s Responsible Wagering –
Take a Break Policy (available here) (Break),
any associated Bet Loop Profile will be suspended for the period of the Self-Exclusion
and/or Break, however RWWA accepts no duty of care of liability in the event this does
not occur.
3.3 Without limiting the above, RWWA may take such actions where you are, or RWWA
considers you may be:
(i) younger than 18 years of age;
(ii) placing bets on behalf of another person;
(iii) in breach, or will be in breach, of the Rules or these Bet Loop Terms
and Conditions;
(iv) in breach of any applicable law; or
(v) otherwise responsible for any action that poses (in RWWA’s absolute
discretion) a significant risk to RWWA.
4 Bet Loop awards and badges
4.1 RWWA may use ‘badges’ or ‘awards’ (Bet Loop Badges) on a Bet Loop Profile that
appear near a username when the user shares a bet.
4.2 These are intended to be markers of achievements or engagement with the Bet Loop
Features, but are for informational purposes only and are not advice, a
recommendation to place bets, or a professional opinion in relation to the success or
otherwise of prospective bets.
4.3 RWWA will seek to attribute Bet Loop Badges consistently and accurately, but you
should not rely on Bet Loop Badges when making a decision in relation to a bet (for
example, whether to place a bet or the size of the bet). RWWA is not liable, and you
have no claim, in relation to any bets based on any displayed Bet Loop Badges.
4.4 RWWA has the right to change or remove Bet Loop Badges at any time and for any
reason without prior notice.
5 Intellectual property
5.1 To the extent that any intellectual property rights subsist in Bet Loop Content (IP), you
acknowledge and agree that such IP is assigned to RWWA by you immediately upon
creation and that, for the avoidance of doubt, RWWA owns and will own all Bet Loop
Content. However, you indemnify RWWA for any liability for any Bet Loop Content
including any breaches of law or infringement of intellectual property or rights of a third
person.
5.2 You acknowledge and agree that RWWA may reuse, publish, distribute and
communicate any Bet Loop Content on any platform or distribution channel, including
for marketing and promotional purposes. In doing so, RWWA will (at RWWA’s
discretion) use reasonable efforts to attribute the Bet Loop Content to your Bet Loop
Profile but is under no obligation to do so if it is not practical or feasible in the
circumstances.
5.3 As between you and RWWA, all content, software, images, text, graphics and other
intellectual property rights in Bet Loop and the Bet Loop Features (the Bet Loop IP)
are either owned or licensed by RWWA. The Bet Loop IP may not be downloaded,
reproduced, modified, adapted, published or commercialised (nor can any derivative
work be made) without RWWA’s or, where applicable, RWWA’s licensors’ prior written
consent.
6 Exclusion of liability
6.1 To the extent permitted by law, Bet Loop and the Bet Loop Features are provided “as
is” and RWWA makes no warranty or representation to you with respect to them.
6.2 To the extent permitted by law, Bet Loop and the Bet Loop Features are used at your
own risk and RWWA accepts no liability with respect or in connection with your use of
them.
7 Other
7.1 RWWA is established under the RWWA Act 2003. Being a state authority RWWA is
specifically excluded from the provisions of the Privacy Act 1988 (Cth) and as such,
RWWA is not bound by the National Privacy Principles. Notwithstanding this, RWWA
understands that its customers value their privacy and expect their affairs to be kept
confidential. Personal information that you provide to RWWA in using the Bet Loop
Features will be collected, used, and disclosed by RWWA in accordance with the Rules
and RWWA’s Privacy Policy, found here.
7.2 The RWWA Act and Regulations will be used to adjudicate any dispute in relation to
the Bet Loop Features or a Bet Loop Profile. Visit TABtouch.com.au or contact the

breaching the Bet Loop Terms and Conditions or the Rules.
